The Lester Partnership Pty Limited ABN 31 076 127 323 (Lester) and its associated companies (The Lester Group) understand the importance of ensuring the privacy of your Personal Information. In the following paragraphs we explain how we manage your Personal Information in accordance with the Privacy Laws, including the National Privacy Principles. Personal Information means information or an opinion, whether recorded in a material form or not, from which your identity is apparent or can reasonably be discovered. 1. Collection of Personal Information
1.1 Method
Lester collects information from cv's, resumes, letters, faxes, e-mails, interviews, industry referrals sources, telephone, and other sources in the course of assisting clients and candidates in the normal course of our business. We may also, from time to time, collect information from a third party eg. from a nominated referee or from performance assessments. Wherever possible we will obtain your consent prior to doing this. We only collect Personal Information by lawful and fair means.
1.2 Purpose
We are not an employment agency. We collect Personal Information to create and update the Lester List. The Lester List assists candidates seeking employment through an independent recruitment or personnel agency, to obtain market and salary information, to identify and advise on industry developments and needs, or any necessarily related purpose.
Generally, Lester does not disclose your personal information without your consent unless disclosure:
- is required by law, or
- is necessary, in our normal course of business to carry out our contractual obligations to you, or
- is required in circumstances where you would reasonably expect disclosure, such as facilitating the lodgement of your tax return at the Australian Taxation Office, or organising work visas from the Australian Department of Immigration and Multicultural and Indigenous Affairs and if you have asked us to provide these services.
1.3 Website Information is also collected from our website either from on-line applications or generically where we can assess how many visitors have accessed our site, and the frequency with which particular areas of our site have been visited. We use this information to ensure our site is as useful as possible for you and helps maintain and enhance our service levels.
2. Sensitive Information
In some circumstances (for example in submitting a cv or resume) you may provide us with sensitive information such as political or religious affiliations, race or ethnicity. Please inform us if you do not wish to have this information disclosed in the normal course of our business. Where we actively seek such information we will seek your prior written consent.
3. Disclosure of Personal Information
Personal Information may be disclosed to our colleagues or related companies overseas, and will be disclosed to recruitment and personnel agencies, potential employers, contractors, referees or other third parties where that is necessary for us in doing what we have agreed to do for you. Lester does not sell, rent, trade or license Personal Information supplied by candidates or referees. Lester does not, unless required by law, disclose Personal Information it has collected to other organisations unless that disclosure is authorised by the Privacy Act.
4. Access to Personal Information
You have the right to request access to the information we hold about you or about our privacy policy. For information, please send a written request to:

We will endeavour to respond as quickly as possible. However, some information may be archived and may take time to retrieve. Please allow for this. In some cases, a fee may be payable.
5. Keeping Information Up-to Date
We appreciate that the information in CV’s and resumes can change fairly quickly or become outdated. If your Personal Information changes, please contact us and we will endeavour to update and correct the information immediately. We may also contact you from time to time to check the information is still correct. We may store your Personal Information indefinitely, and retain or restore you to the Lester List if we believe you have future prospects with Lester clients. In other cases, we would usually destroy applications and all supporting material 24 months after your last posting, employment or assignment.
6. Security of Personal Information
Lester takes all reasonable steps to ensure the security of your Personal Information, (which may be stored electronically or in hardcopy) and to prevent any misuse or unauthorised disclosure. Only authorised Lester personnel will have access to your Personal Information. Computer access to our data base is pass worded, and hard copies are held in locked cabinets. All Lester employees are required, as a condition of their employment, to keep Personal Information confidential.
7. Outside Australia
We may send Personal Information outside Australia to recruitment or personnel agencies or to potential employers and to organisations providing consultancy services to them. We will only do so where the organisation receiving the Personal Information is subject to statutory or contractual obligations ensuring an equivalent degree of protection of your privacy to the protection you enjoy under Australian law.
8. Opting Out
If at any time you wish to be deleted from our data base, please let us know. We will accept and act on your instructions immediately, and return or destroy materials recording your Personal Information.
9. Updating This Privacy Policy will be reviewed and updated periodically. |
